These are the rules of the court — the agreement that governs your use of DinkTap. Written in plain English, but still a binding contract. Please read carefully; the important bits about disclaimers and disputes are in their own sections.
Acceptance of Terms
Welcome to DinkTap. These Terms of Service (“Terms”) form a binding contract between you and DinkTap, LLC (“DinkTap,” “we,” “us,” or “our”) governing your use of our mobile applications, the Captain & Management Portal, and any related websites (the “Services”).
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Services.
Your Account
To use most features, you’ll need an account. When you create one, you agree to:
- Provide accurate, current, and complete information.
- Keep your password confidential and not share your account with anyone else.
- Be at least 13 years old (or the minimum age required in your jurisdiction).
- Notify us promptly of any unauthorized use of your account.
You’re responsible for all activity that happens under your account. We may suspend or terminate accounts that violate these Terms or that appear compromised.
Acceptable Use
DinkTap is for pickleball players, clubs, and organizers in good faith. You agree not to:
- Use the Services to harass, threaten, stalk, or harm other users.
- Post or share content that is illegal, hateful, fraudulent, sexually explicit, or that infringes others’ rights.
- Manipulate match results, ratings, leaderboards, or rankings — including coordinating fake matches to inflate or deflate DMR™.
- Scrape, mine, or reverse-engineer the Services or attempt to bypass security controls.
- Use the Services to send spam, malware, or unwanted commercial messages.
- Resell, sublicense, or commercially redistribute any portion of the Services.
We may remove content and suspend accounts that violate these rules. See our Trust & Safety page for how we handle reports.
User Content
You retain ownership of the content you post — your profile, photos, match notes, messages, club rosters, schedules, and so on (“User Content”).
To operate the Services, you grant DinkTap a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your User Content solely to provide the Services to you and the people you share it with. We won’t use your User Content for advertising or sell it to third parties.
You’re responsible for your User Content and represent that you have the rights necessary to post it. We may remove content that violates these Terms, applicable law, or third-party rights.
Clubs, Captains & Organizers
If you operate a club, league, or event on DinkTap (a “Club”), additional terms apply:
- You’re responsible for the legality of events you host — including any required permits, waivers, safety measures, and accurate fee disclosures.
- You must comply with applicable consumer-protection law when collecting registration fees, refunds, and prizes.
- You may not impersonate another club, venue, or organizer.
- You’re responsible for ensuring your roster members consented to having their information stored in your Club on DinkTap.
- You agree to honor the standings, scores, and outcomes produced by DinkTap features unless you’ve notified participants in advance of an alternative method.
Subscriptions & Billing
Some features require a paid subscription or one-time purchase. Here’s how that works:
- Billing. We bill in advance on a recurring basis (monthly or annual) until you cancel. Prices and applicable taxes are shown at checkout.
- Free trials. Free trials convert to paid subscriptions automatically. You can cancel any time before the trial ends to avoid being charged.
- Refunds. Recurring subscription fees are non-refundable except where required by law. We may issue refunds on a case-by-case basis.
- Price changes. If we change prices, we’ll notify you at least 30 days in advance. New prices take effect on your next renewal.
- Cancellation. Cancel any time in Settings → Subscription. You keep access until the end of the current billing period.
Mobile app purchases are processed by Apple or Google and are subject to their store policies — including their refund procedures.
Intellectual Property
The Services, including the DinkTap name, logos, the Dynamic Mesh Rating™ (DMR™), DinkTrack™, DinkVision™, and all software, designs, and content we create, are owned by DinkTap and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. All other rights are reserved.
If you believe content on DinkTap infringes your copyright, please send a DMCA-compliant notice to dmca@dinktap.com.
Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, DinkTap disclaims all warranties — express, implied, or statutory — including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
DinkTap does not guarantee that the Services will be uninterrupted, error-free, or perfectly accurate. Skill ratings, match outcomes, and event results are calculated automatically and may contain errors. You agree to verify important data and to play, organize, and book responsibly.
DinkTap is not a sports authority, licensing body, or substitute for professional officiating. We don’t certify rankings for external competitions.
Limitation of Liability
To the fullest extent permitted by law, DinkTap and its officers, directors, employees, and affiliates will not be liable for:
- Indirect, incidental, special, consequential, exemplary, or punitive damages.
- Lost profits, lost data, lost goodwill, or substitute services.
- Personal injury, property damage, or other harm arising from your participation in pickleball activities you coordinate or attend via the Services.
Our total aggregate liability to you for any claim arising out of these Terms or the Services will not exceed the greater of (a) one hundred U.S. dollars ($100), or (b) the amount you paid DinkTap in the 12 months before the event giving rise to the claim.
Termination
You may stop using the Services at any time. You can delete your account from Settings → Privacy → Delete Account.
We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or if continued provision is no longer commercially viable. Where reasonably possible, we’ll notify you first and give you an opportunity to export your data.
Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution — will survive.
Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
You may opt out of the arbitration agreement by emailing legal@dinktap.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your account email in the body.
Where arbitration is not enforceable, the courts located in Harris County, Texas will have exclusive jurisdiction.
Changes & Contact
We may update these Terms from time to time. When changes are material, we’ll notify you in the app or by email at least 30 days before they take effect. Continued use of the Services after the effective date means you accept the updated Terms.
